Posición de Uruguay frente a la decisión adoptada por Tribunal Constitucional de
COMUNICADO DE PRENSA
El gobierno de la República Oriental del Uruguay lamenta la decisión adoptada por el Tribunal Constitucional de República Dominicana de declarar la inconstitucionalidad del Instrumento de Aceptación de la Competencia de la Corte Interamericana de Derechos Humanos, suscrito en el año 1999 por el entonces presidente de ese país, Leonel Fernández.
Esta decisión podría tener consecuencias jurídicas que debilitarían el compromiso de República Dominicana con el sistema interamericano de Derechos Humanos, al privar de efectividad a los instrumentos del sistema respecto a este país.
Uruguay reafirma su posición tradicional de firme respaldo del sistema interamericano de derechos humanos y el funcionamiento de sus dos órganos principales, la Corte Interamericana de Derechos Humanos y la Comisión Interamericana de Derechos Humanos, al constituir ellos una garantía para el acceso a la justicia de las víctimas de violaciones de los derechos humanos.
En tal sentido, representan instrumentos esenciales para la protección de los derechos fundamentales en nuestro continente, así como también una fuente normativa que ha inspirado y fortalecido los sistemas nacionales de protección a nivel regional.

The government of the Republic of Uruguay regrets the decision adopted by the Constitutional Court of the Dominican Republic to declare unconstitutional the Instrument of Recognition of the Jurisdiction of the Inter-American Court of Human Rights, signed in 1999 by the former President of that country, Leonel Fernández.
This decision could have legal consequences that would weaken the commitment of the Dominican Republic with the inter-American human rights system, by preventing the instruments of the system from having effects in that country.
Uruguay reaffirms its traditional position of strong support for the Inter-American human rights system and the operation of its two main bodies, the Inter-American Court of Human Rights and the Inter-American Commission on Human Rights, as they guarantee the access to justice for victims of human rights violations.
As such, they represent essential tools for the protection of fundamental rights on our continent, as well as a legal source that has inspired and strengthened national protection systems at regional level.
